2.5 Our terms and conditions are separate from our privacy policy, and as such, the respective policies cannot be taken out of context from one another.

You are not permitted to publish, manipulate, distribute, or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this Website, nor may you use any such content in connection with any business or commercial enterprise.

Delivery of goods

5.1 We may cancel an order at our sole discretion at any time before the goods have been delivered. For ongoing subscriptions, we may cancel the service immediately and without prior warning unless otherwise prohibited by this document.

5.2 Delivery costs may be charged in addition to product prices; such additional charges are clearly displayed where applicable, may also be found on our delivery and returns page, and will always be shown in 'total cost' at the time of purchase.

5.3 Dispatch or delivery dates/times are only given as estimates, and we are not responsible for any delays.

Terms of sale

6. To contract with Numskull.us, you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. That means if you're banking with the Royal Bank of Very Suspicious International Transactions, we maintain the right to refuse an order. Numskull.us retains the right to refuse any request made by you. If your order is accepted, we will inform you by email, and we may confirm the identity of the party with whom you have contracted.

In most cases, this will be with Numskull.us, or, in some cases, with a third party. Where a contract is made with a third party, Numskull.us is not acting as either agent or principal, and the contract is made between you and that third party and will be subject to the terms of sale which they supply you. When placing an order, you undertake that all details you provide to us are true and accurate, that you are an authorized user of the credit or debit card used to place your order, and that there are sufficient funds to cover the cost of the goods. The cost of foreign products and services may fluctuate due to exchange rates, and we cannot be held responsible for any losses resulting from exchange rate fluctuations. All advertised prices are subject to changes we may make at our sole discretion.

Payment

7.1 We will take payment either on or at the time after delivery of the goods or before dispatch of the goods.

7.2 Where payment is due after or on delivery of goods, you must pay within 30 days unless stated otherwise in the agreement of sale.

7.3 If you do not pay as described in clause 8.2, we reserve the right, at our sole discretion, to suspend, reclaim, or limit your services, as appropriate.

7.4 If you have not paid as described in clause 8.2, we reserve the right, at our sole discretion, to charge interest on the outstanding amount at the rate of 6% per annum above the base rate of the Bank of England, until such time that the outstanding amount is paid in full.

7.5 We reserve the right to accept or decline payment methods at our discretion. You must not proceed with a sale if you are unable to pay using one of the payment methods we offer.

Sales, Voucher Codes & Special Offers

8.1 We retain the right to change product prices for special offers and sales without notice. If a consumer purchases a product at full price and it is later reduced, we will not refund the difference unless there are extenuating circumstances.

8.4 Discount codes cannot be used in conjunction with a special offer (for example, the use of a 10% off discount code with a BOGOF offer).

8.5 You cannot combine more than one discount code, but you can take advantage of multiple special offers in one order.

8.6 If you return 1 item from a 'buy one, get one-half price' offer, you will be refunded for that item but charged full price for the item you keep. Full returns will be given a full refund.

8.7 Items marked as Shop Soiled are exempt from the refund policy and are purchased at the buyer's own risk.

9.8 Discount codes cannot be applied to existing orders retrospectively

9.9 Discount codes cannot be used on Quarter Arcades, Clearance, Shop Soiled, and Promotional Products.

9.10 Postage discounts or free postage codes cannot be used on sale or clearance items.

Unless expressly stated to the contrary to the fullest extent permitted by law Numskull.us and its suppliers, content providers and advertisers hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity and shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of this Website or the Linked Sites and any materials posted thereafter, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law or otherwise. This does not affect Numskull.us's liability for death or personal injury arising from its negligence, fraudulent misrepresentation, misrepresentation as to a fundamental matter, or any other liability which cannot be excluded or limited under applicable law.

Invalidity

If any part of the Terms of Service is unenforceable (including any provision in which we exclude our liability to you), the enforceability of any other part of the Terms of Service will not be affected, all other clauses remaining in full force and effect. So far as possible, where any clause/sub-clause or part of a clause/sub-clause can be severed to render the remaining part valid, the clause shall be interpreted accordingly. Alternatively, you agree that the clause shall be rectified and interpreted in such a way that closely resembles the original meaning of the clause /sub-clause as is permitted by law. If our T & C's need a bit of TLC, that doesn't mean the broken bit invalidates the rest. It's common sense, when you think about it?

Indemnity

You agree to indemnify, defend, and hold harmless Numskull.us, its directors, officers, employees, consultants, agents, and affiliates, from all third-party claims, liability, damages, and/or costs (including, but not limited to, legal fees) arising from your use of this Website or your breach of the Terms of Service. We're good people, so please don't be mean to us if things go wrong.

Waiver

13. No waiver by us of any breach of these Terms and Conditions by you shall be considered as a waiver of any subsequent breach of the same or any other provision.

Severance

14. If one or more of these Terms and Conditions is found to be unlawful, invalid, or otherwise unenforceable, that / those provisions shall be deemed severed from the remainder of these Terms and Conditions (which will remain valid and enforceable).

Termination

15.1 This agreement will remain in full force until:

(i) you stop using our services;

(ii) we terminate the agreement, for any reason, at our discretion;

(iii) any terms of this document are violated or breached by you;

(iv) your use of our services poses a security risk to other users;

License and Site Access

16.1 Numskull.us grants you a limited, revocable, non-exclusive license to access and make personal, non-commercial use of this Website. This license strictly prohibits:

• Any resale, redistribution, or other commercial exploitation of the Website or its contents;
• The collection and use of any product listings, images, descriptions, or prices for commercial purposes;
• Any derivative use of the Website or its contents;
• Any downloading, copying, or transmission of account or customer information for the benefit of another business or third party;
• The use of data mining, scraping, robots, or similar data-gathering and extraction tools;
• The framing or use of framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Numskull.us without express written consent.

16.2 Additionally, you are strictly prohibited from sharing, distributing, or otherwise disclosing any product, collection, or other proprietary information obtained from Numskull.us with any third party, whether for commercial or non-commercial purposes, without our prior written consent.

16.3 Unauthorized use of this Website terminates the permission or license granted by Numskull.us. It may give rise to a claim for damages and/or constitute a criminal offense under applicable UK laws, including, but not limited to, the Computer Misuse Act 1990, the Data Protection Act 2018, and the Consumer Protection from Unfair Trading Regulations 2008. 

16.3 This site may not be reproduced, duplicated, copied, sold, resold, or otherwise exploited for any commercial/social purpose without the written consent of Numskull.us

Pre-Orders

17. Pre-order dates for products are best estimates.
Although we do our best to ensure our estimated arrival date is as accurate as possible, it is provisional. I will get back to you with delivery information from the supplier.

18.1 By registering for our email marketing list, you expressly consent to receiving marketing communications from us via email and are 16+ years of age. You further acknowledge and agree that your personal data may be processed and utilized for targeted advertising purposes, including but not limited to ad targeting through Google and Meta services.

I. Eligibility

• The Numskull Email Sign-Up Discount ("Promotion") is open to individuals aged 18 or over. 
• Participants must be new customers subscribing to Numskull.us email marketing for the first time.
• A valid email address is required.
• Employees of Yellow Bulldog Ltd or Rubber Road Ltd (the company operating Numskull.us), their affiliates, agents, or anyone professionally connected with this Promotion, and their immediate families, are not eligible.

ii. How to Redeem

• To receive the discount, participants must subscribe to Numskull's email marketing communications at www.Numskull.us.
• Upon successful subscription, a unique discount code will be emailed to you. 
• The code entitles the recipient to 10% off their first order on Numskull.us.
• The discount code must be applied at checkout and cannot be added retrospectively.

iii. Offer Conditions

• The discount code is valid for 14 days from the date of issue.
• The offer is valid for one-time use only per customer.
• The discount applies to full-price items only and excludes sale items.
• The code is non-transferable, non-exchangeable, and cannot be redeemed for cash or any alternative.
• Numskull reserves the right to withdraw or amend the Promotion at any time without prior notice.

• By subscribing, you agree to receive email marketing communications from Numskull.us, operated by Yellow Bulldog Ltd.
• You may unsubscribe at any time using the link provided in any marketing email.
• If you unsubscribe, any unused discount code may become invalid.

Mobile Terms of Service

19.1 The Numskull mobile message service (the "Service") is operated by Numskull ("Numskull", "we", or "us"). Your use of the Service constitutes your agreement to these terms and conditions ("Mobile Terms"). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time, and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

19.2 By consenting to Numskull's SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Numskull through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order status updates, account alerts). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

19.3 You understand that you do not have to sign up for this program to make any purchases, and your consent is not a condition of any purchase with Numskull. Your participation in this program is completely voluntary.

19.4 We do not charge for the Service, but you are responsible for all charges associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

19.5 You may opt out of the Service at any time. Text the single keyword command STOP to Numskull or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device unless you initiate them. If you have subscribed to other Numskull mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

19.7 We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received. We will not be responsible for honoring requests made in such messages.

19.8 The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program using that number.

19.9 To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
